TERMS & CONDITIONS

This is a legal agreement between you and Matchmaking Circle / Cupids Arrow Events that are sponsored by Matchmaking Circle / Cupids Arrow will be attended at your own risk, and Matchmaking Circle / Cupids Arrow shall not be held liable for any loss or injury sustained, either directly or indirectly, by any person attending an event. You represent and warrant that the biographical information you provide to Matchmaking Circle / Cupids Arrow is true and accurate.

Matchmaking Circle / Cupids Arrow does not screen its members in any way nor verify the accuracy of biographical information provided by members. As a result, Cupids Arrow WILL NOT BE LIABLE FOR ANY DAMAGES, DIRECT, INDIRECT, INCIDENTAL AND/OR CONSEQUENTIAL, ARISING OUT OF THE USE OF THIS SERVICE, INCLUDING, WITHOUT LIMITATION, DAMAGES ARISING OUT OF COMMUNICATING AND/OR MEETING WITH OTHER MEMBERS OF THIS SERVICE, OR INTRODUCED TO YOU VIA THIS SERVICE. SUCH DAMAGES INCLUDE, WITHOUT LIMITATION, PHYSICAL DAMAGES, BODILY INJURY AND/OR EMOTIONAL DISTRESS OR DISCOMFORT.

LIMITATION OF LIABILITY: IN NO EVENT WILL Cupids Arrow BE LIABLE TO YOU FOR ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES, ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF Matchmaking Circle / Cupids Arrow OR ITS AGENTS OR REPRESENTATIVES KNOW OR HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR TO ANY OTHER PERSON OTHER THAN YOU. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, Cupids Arrow’s LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO Matchmaking Circle / Cupids Arrow FOR THE SERVICE DURING THE TERM OF MEMBERSHIP.

Privacy Policy: Matchmaking Circle / Cupids Arrow maintains a total commitment to the privacy of its clients. Matchmaking Circle / Cupids Arrow will not release any client information without the consent of the Client. Pertinent client information, however, can and will be provided, by Matchmaking Circle / Cupids Arrow personnel only, to other clients in the event that both parties agree that an exchange of information is acceptable.

Consent and Waiver of Liability

This is a legal agreement between you and The Matchmaking Circle/Cupids Arrow. By becoming a member of the service, you agree to be bound by the terms and conditions of this agreement for as long as you continue to be a member.

CONSENT. As a member you agree to provide The Matchmaking Circle/Cupids Arrow with accurate, current and complete personal information, and you consent to the collection, storage and processing of your personal information by Cupids Arrow.

In addition, you consent to allowing Cupids Arrow and its members to share your profile and personal information with prospective dates.

This information will be used solely for the purpose of matchmaking. This information will not be used for any commercial purposes such as direct mailing, mailing lists, or distributed for purposes unrelated to Cupids Arrow. Cupids Arrow does not sell, trade or rent your personal information to others.

You may choose to cease the sharing of your information at any time by contacting Cupids Arrow and the other matchmakers in your group. Please allow a reasonable amount of time for your information to be removed from public availability.

Though we make every effort to preserve user privacy, we may disclose information you provide if required to do so by law or if we have a good faith belief that disclosure is necessary to (1) comply with the law or with legal process served on us; (2) protect and defend our rights or property; or (3) act in an emergency to protect someone's safety.

LIMITATION OF LIABILITY. In no event will Cupids Arrow, nor any other matchmaker associated with Cupids Arrow, be liable (i) to you for any incidental, consequential, or indirect damages arising out of the use of the Service, even if Cupids Arrow, or its agents or associated matchmakers know or have been advised of the possibility of such damages or (ii) to any person other than you. Notwithstanding anything to the contrary contained herein, Cupids Arrow' liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Cupids Arrow, for the service during the continuous term of your active membership. NIETHER CUPIDS ARROW NOR ANY OTHER MATCHMAKER CONDUCTS BACKGROUND CHECKS OR OTHERWISE SCREENS THE POTENTIAL DATES INVOLVED IN THE MATCHMAKING GROUP. AS A RESULT, WE WILL NOT BE LIABLE FOR ANY DAMAGES, DIRECT, INDIRECT, INCIDENTAL AND/OR CONSEQUENTIAL, ARISING OUT OF THE USE OF THIS SERVICE INCLUDING, WITHOUT LIMITATION, DAMAGES ARISING OUT OF COMMUNICATING AND/OR MEETINGS WITH INDIVIDUALS INTRODUCED TO YOU VIA THE SERVICE. SUCH DAMAGES INCLUDE, WITHOUT LIMITATION, PHYSICAL DAMAGES, BODILY INJURY AND OR EMOTIONAL DISTRESS AND DISCOMFORT. IN ADDITION, CUPIDS ARROW DISCLAIMS ALL LIABILITY, REGARDLESS OF THE FORM OF ACTION, FOR THE ACTS OR OMISSIONS OF OTHER MEMBERS OR USERS OF THE SERVICE.

GENERAL PROVISIONS. You expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of California, and that this Release shall by governed by and interpreted in accordance with the laws of the State of California. You agree that if there is any dispute with Cupids Arrow or any associated matchmaker, it will be resolved by binding arbitration in the State of California, based upon the rules of the American Arbitration Association and California law. You agree that in the event that any clause or provision of this Release shall by held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.

I acknowledge that I have read and understand this entire Consent and Waiver of Liability, and I agree to be legally bound by it.
